課程概述

Constitutionalism has gradually taken root in East Asia/Asia. Constitutional review is now being performed in most, if not all, of East Asia/Asia by courts of general jurisdiction or specialized constitutional courts. However, traditional law school approach to the study of constitutional law pays almost little attention to the interaction between constitutional adjudication and politics and to the impact of this interaction on the development of constitutional law in East Asia including Taiwan, Japan, South Korea, Mongolia, China, Hong Kong as well as some Southeast Asian States.
With the publication of Constitutionalism in Asia: cases and Materials (Chang, Thio, Tan and Yeh, Hart 2014), studies on constitutionalism with Asian focus becomes even more feasible. This seminar is aimed at exploring constitutionalism as practice in Asia. The thematic discussion in the seminar will include political participation, equality and equal protection, free speech, religious freedom, and socio-economic right. Students in this seminar are encouraged to have strong participation in the course, as the success of the seminar heavily depends upon the contributions of all participants.

在當代自由民主憲政秩序的發展上,東亞國家愈來愈占有相當之份量,尤其在1980年代末期,南韓及臺灣相繼成為全球表現亮眼之新興民主憲政國家後,更是如此。但由於語言的限制,東亞(及亞洲)各國間並沒有相通的語言,使得東亞或亞洲比較憲法的研究與教學,發展並不容易。所幸,在近年比較研究風潮之下,各國都愈來愈重視將相關憲法發展(尤其是憲法裁判)予以英文化,提供了使用英文的研究者一個深入瞭解東亞(及亞洲)憲政發展並進行比較研究的契機。最近,Constitutionalism in Asia: cases and Materials (Chang, Thio, Tan and Yeh, Hart 2014) 的出版,更使得此一研究成為可能。因此,在台灣思考或研究比較憲法、甚或憲法學理之相關問題,也不能再僅僅是唯歐美國家是瞻。
 

課程目標
In the past, schlarly attention to constitutional developments of Asia has been scant. This seminar thus serves as a critical step to the understanding of constitutionalism as practiced in Asia.

由於過去我們對於東亞憲政發展經驗的瞭解實在有限,這門課程事實上是定位在對東亞憲政研究的初階課程。修課同學對本課程是一個共同的參與者及研究者,一起與授課教師進入此一東亞憲法研究領域。本學期的課程內容將從憲法變遷,民主及政治參與、以及言論自由等議題為主軸,從相關案例中「觀察」、「比較」、「分析」其憲政發展實況。對新議題,對東亞近年發展特別有興趣之同學,對比較憲法研究有初步興趣,或已經厭倦唯歐美憲法是瞻的憲法研究者,都是本課程歡迎加入的對象。
 
課程要求
Students in this seminar are encouraged to have strong participation in the course. Their grades will be based upon their class discussion (50%) and final paper (50%).

本課程將非常重視同學的參與,修課同學應分組(碩士班以下兩人一組)輪流以投影片導讀課程進度,並提出期末報告大綱共同討論,學期成績會以課程參與(50%)及期末書面報告(50%)作綜合評量。
